COMMERCIAL SALON SUITE LEASE AGREEMENT

This Commercial Salon Suite Lease Agreement (“Agreement”) is entered into between Luxe House Georgetown® (“Landlord”) and the Tenant listed on the signed invoice, lease application, or membership agreement (“Tenant”).

By occupying a suite, making payment, or operating within the property, Tenant agrees to all terms, conditions, policies, and procedures outlined below.

This Agreement shall be governed under the laws of the State of Texas.

 

1. PROPERTY USE

Tenant is leasing a commercial salon suite, booth space, office space, or designated work area for business purposes only.

Permitted business types may include, but are not limited to:

• Hair Services
• Esthetics
• Beauty Services
• Wellness Services
• Retail Services
• Approved Professional Services

Tenant may not use the premises for:

• Residential purposes
• Illegal activity
• Medical procedures requiring licensing not disclosed to Landlord
• Hazardous chemical storage
• Excessive noise, nuisance, or disruption
• Activities that violate Georgetown, Williamson County, or Texas regulations

Landlord reserves the right to deny or terminate occupancy for businesses deemed incompatible with the property.

2. TERM OF AGREEMENT

Lease terms may be:

• Weekly
• Monthly
• Month-to-Month
• Fixed Term

Unless otherwise stated in writing, all agreements shall be considered month-to-month commercial occupancy agreements.

A required 30-day written notice must be submitted prior to vacating.

Failure to provide written notice may result in additional charges equal to one billing cycle.

 

3. RENT & PAYMENT TERMS

Tenant agrees to pay all rent and fees on or before the due date listed in their invoice or agreement.

Accepted payment methods may include:

• ACH
• Autopay
• Website Subscription Billing
• Check
• Approved Digital Payment Methods

Late Fees:

• $75 late fee after missed due date
• Additional $10 per day thereafter until paid in full

If payment is more than 15 days late, Landlord reserves the right to:

• Suspend property access
• Disable entry access
• Terminate the agreement
• Begin collections or legal action allowed under Texas law

Returned checks may incur additional fees.

No refunds shall be issued for:

• Partial occupancy periods
• Missed business days
• Voluntary move-outs
• Business slowdown
• Personal scheduling conflicts

4. SECURITY DEPOSITS & FEES

Any deposit paid shall be held as a security deposit unless otherwise stated.

Security deposits may be applied toward:

• Property damage
• Unpaid rent
• Cleaning fees
• Lost keys or access devices
• Unpaid invoices

 

Deposits are not automatically considered the final month’s rent.

All deposits paid to Luxe House Georgetown®, including suite hold deposits, security deposits, onboarding deposits, and reservation deposits, are NON-REFUNDABLE unless otherwise required by Texas law or agreed to in writing by Landlord.

Administrative fees, onboarding fees, and digital setup fees are non-refundable.

 

5. TENANT CONDUCT

Tenant agrees to maintain professional conduct at all times.

The following are prohibited:

• Harassment of tenants, staff, or guests
• Solicitation or recruitment of current Luxe House tenants
• Defamation of the property or tenants
• Verbal threats or abusive behavior
• Physical altercations
• Drug use or illegal conduct on property
• Excessive noise or disruptive conduct

Landlord reserves the right to terminate occupancy immediately for conduct deemed threatening, disruptive, unsafe, or damaging to the business environment.

6. NON-SOLICITATION POLICY

Tenant agrees not to directly or indirectly solicit, recruit, advertise to, or interfere with current Luxe House Georgetown® tenants, employees, contractors, or clients during occupancy and for 12 months following termination of occupancy.

This includes:

• Attempting to relocate tenants to another salon
• Marketing competing suite rentals directly to tenants
• Offering incentives for tenants to leave Luxe House Georgetown®
• Using tenant relationships obtained through the property for competitive solicitation

Violation of this section may result in immediate termination and legal action.

 

7. ACCESS & PROPERTY HOURS

Tenant shall receive access credentials upon approval.

Tenant agrees:

• Not to duplicate keys, fobs, or access codes
• Not to share access credentials
• To secure the building when leaving
• To ensure guests exit the premises appropriately

Landlord may change access codes or systems at any time.

Landlord reserves the right to access the premises for:

• Emergencies
• Maintenance
• Inspections
• Safety concerns
• Property protection

Reasonable notice will be provided when possible.

8. CLEANLINESS & MAINTENANCE

Tenant is responsible for maintaining cleanliness within their suite and shared spaces after use.

Tenant agrees to:

• Remove trash regularly
• Clean stations after use
• Properly dispose of chemicals and supplies
• Maintain sanitary conditions required by Texas licensing boards

Landlord may charge cleaning or repair fees for:

• Excessive mess
• Damage
• Improper disposal
• Plumbing misuse
• Furniture or wall damage

9. INSURANCE & LICENSING

Tenant is solely responsible for:

• Maintaining active business licensing
• Maintaining professional licensing
• Obtaining liability insurance
• Complying with Texas Department of Licensing and Regulation requirements

Landlord is not responsible for:

• Tenant business losses
• Theft
• Equipment damage
• Loss of income
• Client disputes

Tenant is encouraged to maintain renter’s and liability insurance.

 

10. INTERNET, UTILITIES & AMENITIES

Shared utilities and amenities may include:

• Wi-Fi
• Shared lobby
• Conference areas
• Kitchen areas
• Restrooms
• Shared retail areas

Landlord does not guarantee uninterrupted internet or utility service.

Temporary outages shall not constitute lease default or grounds for rent withholding.

Premium Wi-Fi plans or upgraded services may require separate payment.

 

11. GUESTS & CLIENTS

Tenant is responsible for the conduct of their clients, guests, employees, and assistants.

Tenant agrees to:

• Ensure clients behave appropriately
• Avoid overcrowding common areas
• Prevent damage caused by guests
• Supervise minors when present

Landlord reserves the right to remove disruptive guests.

12. PARKING

Parking availability is first-come, first-served unless otherwise designated.

Reserved spaces may only be used by authorized individuals.

Unauthorized vehicles may be towed at owner's expense.

Special event parking rules may apply during community events.

13. ALTERATIONS & DECOR

Tenant may not:

• Paint walls
• Install plumbing or electrical work
• Mount permanent fixtures
• Alter structural elements

Without prior written approval from Landlord.

Approved alterations become property of Landlord unless otherwise agreed in writing.

Tenant is responsible for restoring the space upon move-out if requested.

 

14. TERMINATION & DEFAULT

Landlord may terminate this Agreement for:

• Nonpayment
• Lease violations
• Illegal activity
• Safety concerns
• Harassment or solicitation violations
• Property damage

If Tenant enters into a fixed-term lease agreement, Tenant remains financially responsible for the full lease term signed, regardless of early move-out, business closure, relocation, or voluntary cancellation.

Early termination or abandonment of the leased space shall not release Tenant from:

• Remaining rent owed under the lease term
• Outstanding fees
• Late charges
• Repair costs
• Collection costs
• Legal expenses permitted under Texas law

In the event of nonpayment or contract cancellation, Luxe House Georgetown® reserves the right to:

• Accelerate remaining lease payments due under the agreement
• Send unpaid balances to collections
• Pursue legal remedies permitted under Texas commercial lease law
• Report unpaid debt to applicable collection agencies
• Restrict access to the property until balances are resolved

Tenant understands that reserving a suite removes the space from the market and may cause business loss to Landlord if the agreement is breached.

Month-to-month agreements require a minimum 30-day written notice prior to termination. Failure to provide proper notice may result in additional charges equal to one billing cycle.

Tenant may be removed from the premises pursuant to applicable Texas commercial property laws.

Any unpaid balances may be sent to collections.

Tenant shall remain liable for unpaid fees, damages, and legal costs permitted by law.

 

15. ABANDONED PROPERTY

Property left behind after move-out or lockout may be considered abandoned after the time permitted under Texas law.

Landlord may remove, dispose of, or store abandoned items at Tenant expense.

16. LIMITATION OF LIABILITY

Landlord shall not be liable for:

• Loss of business income
• Theft
• Personal injury caused by Tenant negligence
• Equipment failure
• Weather events
• Acts of third parties
• Internet outages

Tenant agrees to indemnify and hold harmless Landlord from claims arising from Tenant operations.

 

17. MEDIA & MARKETING

Landlord may photograph or record common areas for marketing purposes.

Tenant grants permission for incidental inclusion of business branding or shared-space imagery unless otherwise requested in writing.

 

18. DISPUTE RESOLUTION

This Agreement shall be governed by Texas law.

Venue for disputes shall be Williamson County, Texas.

If legal action becomes necessary, the prevailing party may recover reasonable attorney fees and court costs where permitted by law.

 

19. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties unless modified in writing.

Failure by the landlord to enforce any provision shall not waive future enforcement rights.

If any section is deemed unenforceable, the remaining provisions shall remain valid.

 

WEBSITE POLICY NOTICE

These policies, procedures, terms, and conditions are published for informational purposes and apply to all current and future tenants, occupants, contractors, guests, and businesses operating within Luxe House Georgetown®.

By making payment, occupying a suite, using the premises, or conducting business on the property, Tenant acknowledges and agrees to comply with all policies listed herein.

Luxe House Georgetown® reserves the right to update, modify, or revise these policies at any time without prior notice, as permitted under Texas law.
